Welcome to HippUp Fitness ("HippUp," "we," "us," or "our"). By creating an account or using our platform at hippupfitness.com, you agree to these Terms of Service. Please read them carefully.

1. Service Description

HippUp is an online fitness coaching platform that provides prerecorded workout videos for all age groups, including Kids (6-12), Teens (13-17), Adults (18-64), and Seniors (65+). Content is delivered through a subscription-based streaming service accessible via web browsers on any device.

2. Account Terms

• You must be at least 13 years old to create an account. Users under 18 require parental or guardian consent.
• Each account is for a single individual. Family plan accounts may share access with up to 5 household members as specified in the plan terms.
• You are responsible for maintaining the security of your account and password.
• You must provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at [email protected] if you suspect unauthorized access to your account.

3. Subscription & Billing

• Free Tier: Limited access to selected workout videos at no cost.
• Pro Plan ($19/month): Full access to all workout content for one user.
• Family Plan ($39/month): Full access for up to 5 household members.
• Paid subscriptions are billed monthly and auto-renew unless canceled before the next billing date.
• Payments are processed securely through Stripe. We do not store your full payment card details.
• We may adjust pricing with at least 30 days' notice sent to your registered email. Price changes will take effect at the start of your next billing cycle.

4. Refund Policy

We offer a 30-day satisfaction guarantee. If you are not satisfied with your subscription within the first 30 days, contact us at [email protected] for a full refund. After 30 days, refunds are issued at our discretion. You may cancel your subscription at any time; your access will continue until the end of the current billing period.

5. Content & Intellectual Property

• All workout videos, images, text, and other content on HippUp are owned by or licensed to HippUp Fitness and protected by copyright.
• Your subscription grants you a personal, non-exclusive, non-transferable license to stream content for private, non-commercial use.
• You may not download, copy, redistribute, record, or publicly display any content from the platform.
• You may not use any automated tools to scrape, extract, or mirror our content.

6. Acceptable Use

You agree not to:

• Share your account credentials with anyone outside your subscription plan.
• Use automated bots, scrapers, or similar tools to access the platform.
• Attempt to bypass subscription restrictions or access controls.
• Use the platform for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, or harm other users or HippUp staff.

7. Health & Fitness Disclaimer

HippUp provides fitness content for general wellness purposes. Our videos are not a substitute for professional medical advice, diagnosis, or treatment. Consult your doctor before starting any exercise program, especially if you have pre-existing health conditions. You exercise at your own risk, and HippUp is not liable for any injuries sustained during workouts.

8. Termination

• You may cancel your account at any time from your account settings or by contacting support.
• We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the platform.
• Upon termination, your right to access the platform and its content ceases immediately.

9. Limitation of Liability

To the maximum extent permitted by law, HippUp Fitness and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify you via email at the address associated with your account. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of HippUp shall be resolved in accordance with applicable law.
